Florence Dialysis LLC Variance

NOTICE OF PUBLIC HEARING

The Florence Planning Commission will hold a public hearing at 7:00 P.M. on October 11, 2011, in the Florence City Council Chambers, 250 Highway 101, to hear and consider the following matter:

RESOLUTION PC 11 11 VAR 01 AND AR 11 08 DR 07: two applications from Steven Purvis, Designer, representing Florence Dialysis LLC. One application for a site review to construct a Dialysis Clinic (a use permitted in the Pacific View Business Park) and another application for a variance from the 20-foot vegetated buffer requirement to allow a five-foot vegetation buffer adjacent to the property to the east. The property is located east of Kingwood Street, west of the Siuslaw School District, and north of 27th Street and Dr. Holmes Dental Clinic (Assessors Map Number 18-12-22-42, Tax Lot 1400).

In the site review process, staff found that the Dialysis Clinic is a permitted use and applicant proposed a 5-foot setback. The code requires a 20-foot buffer setback along the eastern property line. The applicant chose to apply for a variance. The variance criteria are:

A. Strict or literal interpretation and enforcement of the specified regulations would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of this Title.
B. There are exceptional or extraordinary circumstances or conditions applicable to the property involved which do not apply generally to other properties classified in the same zoning district, or
C. The granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same zoning district, and
D. The granting of the variance will not be detrimental to the public health, safety or welfare or materially injurious to properties or improvements in the vicinity.

Testimony and evidence must be directed toward the criteria described above or other criteria in the Comprehensive Plan or land use regulations which is believed to apply to the decision. Written testimony may be submitted until October 11, 2011 at 5:00 PM, to the Community Development Department, Florence City Hall, 250 Highway 101, Florence, Oregon, 97439, e-mailed to Michelle Pezley, or faxed to 541-997-4109. Please include a mailing address if submitting comments by fax or e-mail. Failure to raise an issue in person or by letter, or failure to provide sufficient specificity to afford the decision-maker an opportunity to respond precludes appeal based on that issue. The hearing will be conducted in accordance with Florence City Code Title 2, Chapter 10.
